Feb 9 hearing of AG's preliminary objection to Karpal's application

KUALA LUMPUR, Wednesday 26 January 2011 (Bernama) -- The Appellate and Special Powers Court will hear on Feb 9 the preliminary objection by Attorney-General Tan Sri Abdul Gani Patail to senior lawyer Karpal Singh's application for a mandumus order in compelling Chief Justice Tun Zaki Azmi to respond to his letter regarding the alleged misconduct of the chief justice while he was a practising lawyer in 1987.

Justice Datuk Aziah Ali set the date after meeting Gani and Karpal Singh in her chambers today.

Gani later told reporters that he raised his objection on a point of law stated by Karpal Singh in his application.

On Jan 12, Karpal Singh, the DAP chairman and Bukit Gelugor MP, filed leave for a judicial review seeking a court order to force Zaki to explain his "misconduct" with regard to an admission by Zaki on the bribing of court officials during his days as a lawyer.

He is also seeking to have Zaki brought to the Judges Code of Ethics Tribunal.

Karpal Singh is also seeking a court order to prevent Zaki himself from determining the merits of the complaints lodged against him under Section 13 of the Judges' Code of Ethics, 2009.

In his application, Karpal Singh said that the proper authority to hear complaints against Zaki would be a retired chief judge or a retired federal court judge.
